traiantitilincu.com is owned and operated by Titilincu Traian PFA, a freelance creative based in Romania. This platform facilitates the provision of professional graphic design services tailored to the specific requirements of clients. By placing an order, clients confirm their understanding and acceptance of these Terms & Conditions.
Data Protection and Privacy
The collection and processing of personal data shall be conducted in strict adherence to GDPR (Regulation (EU) 2016/679) and Romanian Law No. 190/2018. Personal data provided by clients will be used exclusively for the purpose of delivering contracted services and will not be shared with unauthorized third parties. Prerequisites for Commencing a Project
Before initiating any project, clients must provide all necessary details to ensure that the project can be accommodated within the service provider's availability. This includes, but is not limited to, a clear description of the project scope, design preferences (such as styles, themes, and examples), and any relevant assets (such as photographs, videos, or audio files). Additional context regarding the target audience, branding guidelines, and relevant platforms must also be provided where applicable.
Clients are advised to contact the service provider prior to placing an order to verify that the requested project aligns with the services offered. This ensures that the project is feasible and allows for the clarification of any specific requirements. If clients are unable to provide the required details, the project will proceed under creative freedom, granting the service provider the authority to make decisions regarding the creative direction.
The timelines and pricing for services are outlined in the descriptions provided on the website or in custom proposals shared directly with clients. Delays caused by incomplete or unclear submissions of information or materials will not be attributed to the service provider.
The Client confirms that they have the legal right to use and share all materials needed for the project, such as text, images, logos, and other content. They guarantee that these materials do not violate any third party's intellectual property rights and that the content is not illegal or harmful. The Client also agrees to provide accurate information on time and inform the service provider of any changes to the project or its requirements.
Payment Terms
Clients may fulfill payment obligations using one of the following accepted methods:
Online payments facilitated through the checkout system on the website via Stripe, with available methods including credit cards, debit cards, Apple Pay, Google Pay, or other options depending on the client's location.
Manual payments processed via platforms such as Wise, Revolut, PayPal, Upwork, or traditional bank transfer.
Payments are processed in American dollars (USD) or Romanian leu (RON), depending on prior agreement. Clients are responsible for any ancillary fees, such as currency conversion charges or transfer fees.
Invoices for online payments are automatically generated upon successful payment. For manual payment methods, invoices will be dispatched via email. Clients who require additional business details, such as VAT identification numbers, must provide this information at the time of purchase or prior to invoicing.
Refunds and Cancellation
Clients may request to cancel a project under the following refund framework:
A full refund, excluding any payment processing fees, will be issued if the project has not commenced, specifically prior to the completion of the Creative Direction phase.
50% Refund: A partial refund of 50% will be issued if the project has commenced and is canceled following the completion of the Creative Direction phase, but prior to the presentation of Initial concepts for the client’s review.
20% Refund: A refund of 20% will be issued if the project is canceled after the initial concepts have been presented to the client.
Upon the client's request, a detailed report will be provided, outlining the progress of the project at the time of cancellation, based on the evaluation of completed subtasks. This report will serve to ensure full transparency regarding the current status of the project. Refunds will be processed within 14 business days following the confirmation of cancellation.
The service provider reserves the right to suspend a project if excessive micromanagement, a lack of trust, or an inability to move forward occurs, despite being presented with a reasonable number of unique ideas and concepts. In such cases, the service provider will provide adequate notice and a chance to resolve the issue before considering project suspension or cancellation.
The client also has the right to suspend or cancel the project if the work completed does not meet the agreed-upon objectives or if the customer service experience fails to align with the expectations outlined at the outset of the project.
In the event of cancellation, ownership of all original artwork will remain with Traian Titilincu, unless otherwise explicitly agreed upon. Both parties will make reasonable efforts to address and resolve any concerns before resorting to cancellation.
Collaboration Protocol
Clients are responsible for providing well-organized and easily accessible media files to ensure the project progresses efficiently. Recommended file-sharing platforms include Google Drive, Dropbox, WeTransfer, and iCloud. High-quality, properly organized materials help to streamline the workflow and improve the overall outcome. Delays resulting from disorganized or insufficient submissions will not be the responsibility of the service provider.
Effective communication is key throughout the project. Clients should use designated communication channels, including WhatsApp, Asana, and email, to ensure alignment and maintain momentum. Timely feedback, clarification requests, and active participation are encouraged to facilitate smooth progress.
Revisions and Modifications
The project includes up to three (3) free revisions, which are typically sufficient for refinement. Should additional revisions be necessary, they will incur additional charges, which will be communicated in advance. To ensure the project stays on schedule, it is recommended that revision requests be submitted within the agreed timeline.
Ownership and Intellectual Property Rights
Ownership of the final deliverables will transfer to the client once the project is marked as "complete" by the service provider on project management platforms such as Asana or Playbook, and upon receipt of full payment.
Any third-party components used in the project, such as licensed fonts, stock imagery, or external software, are excluded from the transfer of ownership and will remain subject to their respective licensing terms.
The client is granted a non-exclusive, royalty-free license to use the final deliverables solely for the intended purpose, as outlined in the project agreement. Any resale, redistribution, modification, or use beyond the original scope, without the prior written consent of the service provider, is prohibited, unless explicitly agreed upon.
The service provider retains the right to showcase completed projects in portfolios or promotional materials, except in cases where a non-disclosure agreement (NDA) is in effect. Any disputes concerning intellectual property rights shall be resolved in accordance with the applicable laws of the service provider's country of residence.
Liability Disclaimer
While every effort is made to deliver work of the highest standard and to meet the timelines that have been mutually agreed upon, the service provider cannot be held liable for any losses, damages, or delays that may occur due to circumstances that are beyond their control. These circumstances may include, but are not limited to, technical failures, such as system outages, hardware malfunctions, or software errors, as well as acts of God. Additionally, any disruptions caused by third-party service providers or external factors that may affect the completion of the work, such as delays from suppliers, communication failures, or issues with other service providers, are also considered outside the control of the service provider.
The service provider will make reasonable efforts to minimize the impact of such events and keep the client informed. However, they will not be responsible for any consequences arising from uncontrollable events. Additionally, the service provider's total liability for any claims will be limited to the amount paid by the client for the specific project, reflecting the nature of the circumstances beyond their control.
The Client agrees to indemnify and hold harmless the service provider (Traian Titilincu) and its affiliates from any claims, losses, damages, or costs, including attorney's fees, arising from the Client's use of the final deliverables, breach of these Terms & Conditions, or infringement of third-party intellectual property rights. This obligation remains in effect even after the project ends.
Governing Law and Jurisdiction
These Terms & Conditions are governed by and shall be interpreted in accordance with the laws of the service provider's country. Any disputes arising from or related to these Terms & Conditions or the services provided shall be resolved exclusively in the courts of the service provider's country. Both parties agree to make reasonable efforts to resolve any disputes amicably through mediation or other alternative dispute resolution methods before resorting to litigation. This is subject to the relevant national and international legislation applicable to the dispute.
Age Restriction
By using this website and accessing the services, users confirm that they are at least 16 years of age, or the legal age of majority in their country of residence, whichever is greater. Users under the age of 16 may not use the services without the consent of a parent or legal guardian. The website does not knowingly collect or solicit personal data from individuals under the age of 16. If it is discovered that personal data from a minor has been collected, steps will be taken to delete that information as soon as possible.
